Terms of Use

These terms are an agreement between you and VoiceArc Inc (“VoiceArc”, “we”), the company behind Bonit. By creating an account or using the app, you agree to them. If you do not agree, please do not use Bonit.

Bonit is not medical advice

Bonit is an educational and coaching tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Its guidance is general information adapted to what you tell us, not care from a clinician who has examined your child.

Always talk to your pediatrician or another qualified health professional about your child’s sleep, feeding, growth, or health, and before starting any sleep-training method. Never disregard professional medical advice, or delay seeking it, because of something you read in Bonit.

If you think your child has a medical emergency, stop using the app and contact your local emergency service immediately.

You are responsible for your child’s safety and sleep environment at all times, including following current safe-sleep guidance from your national health authority. You decide whether any suggestion Bonit makes is right for your family, and you remain responsible for that decision.

Who can use Bonit

You must be at least 18 years old and legally able to enter into this agreement. Bonit is for parents and caregivers. It is not directed at children, and children may not use it. You are responsible for keeping your account credentials secure and for activity under your account.

Subscriptions and payment

Bonit is sold as an auto-renewing subscription. Purchases are processed by Apple or Google, not by us. Current pricing, including any introductory offer and the price that applies afterwards, is shown in the app before you buy and again on the store’s confirmation screen.

Your content

You keep ownership of what you put into Bonit — your child’s profile, your recaps, and your messages. You grant us a limited licence to process that content in order to run the service: to generate your plan, to power the coach, and to improve reliability. How it is handled, including our use of an AI provider and the fact that voice recordings are transcribed and then discarded, is described in our Privacy Policy.

You agree not to upload content that is unlawful, or that infringes someone else’s rights, and not to use Bonit to harm anyone.

Our content

The app, its sleep-method content, its design, and the Bonit name and logo are owned by VoiceArc and protected by intellectual-property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own family’s use, subject to these terms.

Availability and changes

We may change, suspend, or discontinue parts of the service. We aim to keep Bonit available but we do not guarantee uninterrupted or error-free operation, and features may change as the product develops. If we discontinue a paid service entirely, we will act reasonably about any period you have already paid for.

Ending your access

You can stop using Bonit at any time and delete your account and data at bonit-api.vercel.app/delete-account. We may suspend or terminate an account that breaches these terms or that we reasonably believe is being used unlawfully.

Disclaimers and liability

To the fullest extent permitted by law, Bonit is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the app will produce any particular result — including any specific improvement in your child’s sleep.

To the fullest extent permitted by law, VoiceArc will not be liable for indirect, incidental, special, or consequential damages, and our total liability arising out of or relating to Bonit is limited to the amount you paid us in the twelve months before the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law — including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection law. If you are a consumer in the EU, EEA, or United Kingdom, you keep all statutory rights you have under the law of your country of residence, and nothing here overrides them.

Apple and Google

Apple and Google are not parties to this agreement and are not responsible for Bonit or for support. Your use of the app is also subject to the applicable app-store terms. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disputes, governing law, and arbitration

We’d rather fix a problem than fight about it. If something goes wrong, email hello@bonit.app first and we’ll try to resolve it informally within 30 days.

If you live in the United States, and we can’t work it out informally, you and VoiceArc agree to resolve any dispute arising out of or relating to Bonit or these terms through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules — or, if the AAA is unavailable or declines to administer, by another nationally recognized consumer arbitration provider under its consumer rules — instead of in court, and each of us waives the right to a jury trial and to participate in a class action. Arbitration will be conducted in English, by videoconference or in the county where you live. Two exceptions: either of us may bring an individual claim in small-claims court, and either of us may seek public injunctive relief in court where the law provides for it. Nothing in this section waives rights that cannot be waived under applicable law. If the class-action waiver is found unenforceable as to a particular dispute, this arbitration section does not apply to that dispute.

You can opt out of arbitration within 30 days of first accepting these terms — or, if you accepted an earlier version without this section, within 30 days of the date this version takes effect — by emailing hello@bonit.app with the subject “Arbitration opt-out” from the email on your account. Opting out does not affect any other part of these terms.

For users in the United States, these terms are governed by the laws of the State of California, excluding its conflict-of-law rules.

If you are a consumer in the European Union, EEA, or United Kingdom, the arbitration agreement and class-action waiver above do not apply to you. You may bring disputes before the courts of your country of residence, you benefit from the mandatory consumer-protection law of that country, and nothing in these terms limits those rights.

Changes to these terms

We may update these terms. If a change is material, we will give reasonable notice — in the app or by email — before it takes effect. Continuing to use Bonit after that means you accept the updated terms.
